DISTANT SALE CONTRACT
This contract is issued to fulfill the obligation of signing an agreement for purchases made over the internet, in accordance with the Regulation on Procedure and Principle of Distance Sale Contracts, published in the Official Gazette No. 16322 on 21.06.2010.
ARTICLE 1 – SUBJECT
This contract outlines the rights and obligations of both parties under the Consumer Protection Law (No. 4077), concerning the sale and delivery of the product(s) sold by the SELLER to the BUYER. The specifications and sale price of the product(s) are detailed below.
ARTICLE 2.1 – SELLER INFORMATION
ARTICLE 2.2 – BUYER INFORMATION
The BUYER is the registered member of the excursions website www.joinexcursions.com. The contact details and address provided during registration shall be considered valid.
ARTICLE 3 – PRODUCT INFORMATION
This section includes details regarding the type, quantity, brand/model, color, sale price, and payment method of the goods/products/services purchased at the time of order confirmation.
ARTICLE 4 – GENERAL PROVISIONS
- The BUYER acknowledges that they have read and understood all pre-contractual details, including product specifications, pricing, and payment terms, and confirms this electronically.
- The product(s) will be delivered to the BUYER or an authorized recipient at the designated address within the estimated timeframe stated during the order process. However, delivery cannot exceed 30 days, unless extended for up to 10 additional days with prior notification.
- If the product is to be delivered to another individual/entity other than the BUYER, the SELLER is not responsible if the recipient refuses to accept it.
- The SELLER guarantees the delivery of the product(s) in perfect condition, complete with any applicable warranties and user manuals.
- If the payment is not received by the SELLER due to unauthorized use of the BUYER’s credit card, the BUYER must return the delivered product within 3 days, covering the return shipping costs.
- In case of force majeure (e.g., severe weather, transport disruptions), the SELLER will notify the BUYER about any delays. The BUYER may then choose to:
- Cancel the order (full refund within 10 days),
- Receive a replacement product, or
- Postpone delivery until conditions improve.
ARTICLE 5 – RIGHT OF WITHDRAWAL
- The BUYER has the right to withdraw from the purchase within 7 days of receiving the product.
- The BUYER must inform the SELLER via fax, email, or phone within this period.
- The product must be unused and returned with the original invoice and courier delivery receipt.
- The refund will be processed within 7 days upon receipt of the returned product and required documents.
- If the original invoice is not provided, VAT and other applicable charges will not be refunded.
- Return shipping costs will be borne by the BUYER.
Additionally, if a credit card or payment card is used fraudulently, the consumer can request cancellation of the payment. The issuing bank must refund the amount within 10 days of the complaint.
ARTICLE 6 – DISPUTE RESOLUTION
In case of disputes, the Consumer Courts in the SELLER’s jurisdiction and arbitration boards specified by the Ministry of Industry and Trade shall have authority.
By placing an order, the BUYER is deemed to have accepted all terms and conditions outlined in this contract
